Procedures for importing machinery

Customs declaration information includes:
– Commercial invoice
– Commercial contract
– Packing slips
– Bill of lading
– Customs declaration of imported goods
– Certificate of origin (C/O) (if any)
New goods 100% customs declaration is quite simple, just do customs procedures, declare tax and receive goods. Second-hand goods, traders need to pay attention to Chapter 84 and Chapter 85 of HS codes of imported products (imported form for commercial consumption) which are managed according to Circular No. 23/2015 of the Ministry of Science and Technology.
Pursuant to Circular 23/2015/TT-BKHCN dated November 13, 2015; Decision No. 18/2019/QD-TTg dated 19/04/2019; Procedures for importing used machinery and equipment:
1. Imported used equipment must satisfy the following conditions:
a) The life of the equipment is not more than 10 years
b) In order to determine the lifespan of equipment and machinery, in addition to providing complete information with paper records, enterprises must register with the center for determining the life of equipment (at the port of entry).
2. Customs dossiers include:
– Age guardian application for imported machinery and equipment
– Commercial Invoice (Commercial Invoice)
– commercial contract (Commercial Contract)
– packing list
– bill of lading
– declaration of imported goods (if required by customs)
– Documents proving the equipment is not older than 10 years
– Certificate of origin if any, preferential import tax.
In addition to imported materials according to the provisions of the Customs Law, enterprises need to add 01 additional set of documents, including:

2.1 Used equipment under the investment project specified in Article 6, Clause 2 of this notice: 01 Decision on investment policy or a certified true copy of Investment Registration Certificate 01 Original List of equipment Imported used is included in the project file
2.2 For other cases of importing used equipment (including the case where the investment project is approved under the investment policy decision of the Investment Authority).

Law or investment registration certificate but no list of expected import of old equipment):
Technical documents showing the year of manufacture and production standards of imported second-hand equipment, including one of the following documents:
– 01 Certificate of manufacturer’s original year of manufacture and production standards of the equipment used in compliance with the provisions of Article 6, Clause 1 of this Circular;
– 01 original of the inspection certificate of the inspection agency specified in Clause 2, Article 10 of this Circular, notifying the year of manufacture and production standards of the equipment used in accordance with Clause 1, Article 6.
